THIS FORUM IS FOR ALL OF THE HOSTV CLIENTS AFFECTED BY THE RECENT SERVER FAILURES. WHILE HOSTV WAS SUPPOSED TO BE DOING DAILY BACKUPS THE DATA LOSS HAS AFFECTED A "SMALL GROUP OF CUSTOMERS" - WHICH SEEMS TO BE EVERYONE! PLEASE JOIN AND COMMUNICATE ANY INFORMATION TOWARDS LEGAL ACTION THAT MAY BE TAKING PLACE.

This is an email I just sent and the response I got:


I do not have any local backups as I depended on you to back up my data. You promised a great new backup system in the email you sent back in December 09. There seems to be a breach in contract.

I have lost everything. I have several questions:

1. Do you have any way of retrieving my sent email addresses? I sent mass emails per week...do you have any record of those emails?
2. I may be able to get my site structure back but it will cost me. Are you prepared to pay the costs I may incur? I have spent thousands to get this site built.
3. Do you have a lawyer? If so, I will need their contact info.

I'm starting to think you did not have any backup strategy in place at all. This makes no sense whatsoever.

No we will not pay the costs you incur. No we have no way of retrieving any of your emails.
I am not aware of any lawyer on staff.

So I spend a week calling all my clients and setting up emails and as of yesterday, I can't even upload 30k without a time-out. They finally said the server was too busy and I should upload small batches. Smaller than 30k? I am migrating away from them as we speak. Count me in on the lawsuit.

That's a shame really -I've requested a refund and was reimbursed for my August payment = 1 year in advance for the VZ1 -- I've asked John if he is going to honor what he told me in his WHT PM to me: "We're doing full refunds, please email billing@hostv.com if you wish to close the account, we'll refund all your VPS payments."

It will be interesting to get his response. "All" means ALL right? hmmm
